1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the website automaate.io and all services provided by Automaate LLC, a Texas limited liability company ("Automaate," "we," "our," or "us"). By visiting our website, submitting a form, or engaging with our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
2. Services
Automaate provides managed AI automation services to small and medium businesses in the Houston, Texas area and surrounding communities. Our services include, but are not limited to:
• Automated SMS review request sequences following customer visits
• AI-generated responses to Google Business and Facebook reviews
• Automated responses to Instagram and Facebook direct messages
• Google Business Profile setup, optimization, and ongoing maintenance
• Voice AI that answers inbound calls, qualifies callers, and books appointments
• Conversation AI - a website chatbot trained on the client's business
• Monthly plain-language performance reporting
Automaate is a managed service provider. Clients do not receive access to or a license for any underlying software platform. All services are delivered and managed by Automaate on behalf of the client.
3. SMS Messaging Terms
This section governs all SMS and text message communications sent by Automaate LLC to users, prospective clients, and active clients. These disclosures are required by The Campaign Registry (TCR), mobile carriers, and the Telephone Consumer Protection Act (TCPA).
3a. SMS Program Description
By providing your mobile phone number to Automaate through any website form, in-person agreement, or verbal consent documented by a sales representative, you agree to receive text messages from Automaate LLC. Our SMS program includes the following message types:
• Responses to inbound inquiries submitted through our website or contact forms
• Onboarding and setup communications for new clients
• Service updates, account notifications, and support messages
• Monthly performance report delivery notifications
• Follow-up messages related to your free audit request or consultation
On behalf of our clients, Automaate also sends automated SMS messages to their customers, including review requests following service completion, appointment reminders, and customer inquiry messages. For these client-directed communications, consent is the responsibility of the client.
3b. Consent
By submitting your mobile phone number on any Automaate form and checking the SMS consent checkbox, you expressly consent to receive text messages from Automaate LLC at the number provided. Consent to receive SMS messages is not required as a condition of purchasing any product or service from Automaate.
3c. Message Frequency
Message frequency varies based on your level of engagement with Automaate and the services in use:
• Prospective clients: up to 4 messages per inquiry
• Active clients: messages sent as needed for service delivery, support, and reporting
• Message frequency may vary. We will not send excessive or unsolicited messages.
3d. Message and Data Rates
Message and data rates may apply. Contact your wireless carrier for details about your plan. Automaate is not responsible for any charges your wireless carrier applies to messages sent or received.
3e. Opt-Out Instructions
You may opt out of receiving SMS messages from Automaate at any time by replying STOP to any message. After opting out, you will receive one final confirmation message. No further messages will be sent unless you re-subscribe by replying START. Opting out of SMS does not affect your ability to receive communications through other channels such as email or phone calls, unless you separately request removal from those channels.

3g. Carrier Disclaimer
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to network availability and carrier policies. Automaate cannot guarantee delivery of all messages.
3h. SMS Data Sharing - Critical Restriction
Mobile information - including mobile phone numbers and SMS opt-in consent data - will NOT be shared with third parties or affiliates for marketing or promotional purposes. All categories of personal information described in these Terms exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties. SMS opt-in and opt-out records are kept private and will never be transferred to third-party marketers. We may share mobile phone numbers only with subcontractors or service providers who assist in the technical delivery of our SMS program (such as GoHighLevel and telecommunications providers), under strict confidentiality obligations, and only as necessary to operate the messaging service.
4. Website Use
You agree to use automaate.io only for lawful purposes and in a manner that does not infringe the rights of others. You may not use the website to transmit harmful, offensive, or fraudulent content. Automaate reserves the right to restrict or terminate access to the website for any user who violates these Terms.
5. Intellectual Property
All content on automaate.io - including text, graphics, logos, and service descriptions - is the property of Automaate LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this website without prior written consent from Automaate.
6. Disclaimer of Warranties
THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. AUTOMAATE DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AUTOMAATE DOES NOT GUARANTEE SPECIFIC BUSINESS OUTCOMES, REVENUE RESULTS, REVIEW COUNTS, OR CALL VOLUMES AS A RESULT OF ITS SERVICES.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUTOMAATE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR SERVICES. AUTOMAATE'S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO AUTOMAATE IN THE THREE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Our website may contain links to third-party websites or reference third-party services such as Google, Facebook, and Instagram. Automaate is not responsible for the content, privacy practices, or terms of any third-party website. Links are provided for convenience and do not constitute endorsement.
9. Privacy Policy
Your use of the Automaate website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. 10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising from these Terms that cannot be resolved through good-faith negotiation shall be submitted to binding arbitration in Harris County, Texas, in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
11. Changes to These Terms
Automaate reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the website or services after any modification constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
